Michael Lohan appears in court after domestic violence charge

(CBS/AP) Michael Lohan appeared in a Tampa Bay, Fla., court to face domestic violence charges. Lohan was accused of grabbing and pushing his on-again-off-again girlfriend's arms after she refused to perform oral sex.

During the Oct. 26 court date, the judge also told Lohan to stay away from 28-year-old Kate Major. Major already had a temporary restraining order against Lindsay Lohan's father in Sarasota County, but she told the court that she allowed Lohan into her residence in order to help her decide whether or not to make the order permanent. This is the third restraining order Major has filed against Lohan.

According to the police report, officers responded to a domestic violence call. When Lohan opened the door, he told them everything was fine, but a woman reportedly yelled for help and claimed "he was lying." Major did not receive medical treatment for her injuries, but TMZ has posted photos of what they claim to be bruises on Major from the altercation.

The report said that the woman told police that she and Lohan had argued because she refused to give him oral sex. She also claimed he had banged his own head on the door and that he intended to blame her for injuring him if police came.

After being taken into custody, Lohan complained of chest pains and was taken to a local hospital. He tried to evade the authorities and check himself out and leave, but officers caught his attempted escape.

A call to Lohan's lawyer, Michael Perry, was not immediately returned.
