PLACERVILLE, Calif. (CBS/AP) Phillip Garrido, the man charged with kidnapping Jaycee Dugard, then raping and holding her in his backyard for 18 years, is looking for a break he would never have given his alleged victim.

Garrido and his wife Nancy want to visit each other in jail while they await trial. Among the things they wish to discuss is, remarkably, the well-being of their alleged captive and the children Garrido fathered by her.

Police are saying no way.

The El Dorado County sheriff's department is fighting the couple's request for in-jail visits. Lawyers for the county filed court papers Tuesday opposing the request.

Phillip and Nancy Garrido's lawyers have asked a judge to compel jail officials to allow the two to meet face-to-face so they can talk about the case, their finances, and their hopes for Dugard and the two daughters she had with Phillip Garrido.

In the papers, Chief Assistant County Counsel Edward Knapp says California law does not give jail inmates a constitutional right to visit each other. He says arranging such visits for the Garridos would overburden jail staff.

A Superior Court judge is scheduled to consider the visitation request on Friday.
