Cursing While Jogging is a Crime? Craig O'Brien Banned by N.H. City for Using Profanity on the Run

PORTSMOUTH, N.H. (CBS/AP) Jogger Craig O'Brien likes to run. He also likes to run his mouth, according to authorities in Portsmouth, N.H., who charged him with disorderly conduct for yelling profanities while running in their fair city last spring and summer. 

Allegedly he's targeted the cops and others on his outings.

But the 28-year-old O'Brien, who's from Eliot, Maine a few miles from Portsmouth, has also run into some other trouble in the case. He was barred from the New Hampshire city while free on bail, an order O'Brien's lawyer argued is unconstitutional.

Attorney Anthony Naro argued Tuesday that a judge should dismiss a charge that O'Brien violated his bail conditions.

But Prosecutor Rena DiLando argued that O'Brien willfully taunted the police with daily visits for a week while out on bail.

The judge has not ruled on the dismissal motion.

Feels like a case they might all like to run away from.
