(CBS/AP) DALLAS - Chung Kim, a Texas man, was charged with capital murder Monday after he allegedly shot and killed a couple who lived upstairs from his northwest Dallas apartment in an argument over dog feces.

Kim, 75, was taken into custody for the shooting deaths of his 31-year-old neighbors, Jamie Stafford and Michelle Jackson, according to a police affidavit. Kim was reportedly feuding with the couple over dog feces dropped onto his patio and front entrance.

Police said Kim shot Jackson on Monday morning when she stepped from her front door onto a balcony. He then went upstairs to her apartment and shot Stafford as he tried to escape through the back patio door and jumped to the ground. Kim stepped onto the back balcony and shot Stafford again. Police arrested Kim nearby.

A police statement said Kim is hospitalized for treatment of a medical condition.

CBS DFW reports that the female victim was the mother of five young children who will now live with relatives. Four of the children were reportedly at school during the shooting attack, while a newborn child was inside the apartment unharmed.

Neighbors told the station that the suspect often complained to management about his neighbors' dog going to the bathroom on their balcony, which often dripped downstairs onto the suspect's patio. Neighbors also said the suspect complained about noise.
