Vermont governor's race will go to the legislature

In a surprising development, CBS News projects Vermont governor's race will head to the state legislature, as neither Democratic Gov. Peter Shumlin nor Republican Scott Milne look poised to clear the 50 percent threshold necessary for victory.

With 76 percent of the vote counted at 12:30 a.m. Wednesday morning Shumlin had 47 percent and Milne 45 percent. Shumlin, the chairman of the Democratic Governors Association, was not considered vulnerable.

According to state law, if no candidate gets an outright majority, the election goes to the state legislature to decide when it convenes in January, according to the Burlington Free Press. Democrats are expected to retain control of both houses, the paper reported, the last time they selected the candidate who did not receive the plurality of the vote was 1853.
