Seaside Man Sentenced To 80 Days In Jail For Third DUI Conviction

SALINAS (CBS SF) -- A Seaside man who was found guilty of driving while under the influence for the third time was sentenced last week, the Monterey County District Attorney announced Thursday.

On Oct. 23, a Monterey County Superior Court judge sentenced Jason Silva, 42, to 80 days in jail and five years probation, according to prosecutors.

On Oct. 21, a jury found Silva guilty of the DUI conviction, as well as driving on a suspended license, prosecutors said.

On Jan. 17, Silva was driving his motorcycle near state Highway 1, north of Moss Landing, according to prosecutors.

Silva somehow lost control of the motorcycle and drove off the road, crashing into an agricultural field. Silva was ejected from the motorcycle during the crash, prosecutors said.

California Highway Patrol officers encountered Silva as he walked on the shoulder of the highway, about a half a mile from the scene of the crash, according to prosecutors.

Silva smelled of alcohol and had bloodshot, watery eyes. Officers found Silva had a blood alcohol level of .16 percent, which is twice the legal limit.
