No Charges Against Man Who Shot, Killed Armed Carjacker In Antioch

ANTIOCH (CBS SF) -- The Contra Costa County District Attorney's Office chose not to file charges Tuesday against an Antioch resident who allegedly shot and killed a man who tried to steal his car at gunpoint last week.

There were no charges filed against 37-year-old Leo Lopez, the apparent victim of a carjacking that officers responded to at 8:31 p.m. Friday at a Rite Aid in Antioch, according to the district attorney's office.

Antioch police had initially arrested Lopez on suspicion of murder following the shooting.

Another man, 26-year-old Timothy Jones, identified by police as being involved with the suspect that day, was charged with conspiracy to commit a crime, attempted second-degree robbery and carjacking, according to the district attorney's office.

Jones was allegedly an accomplice of the 27-year-old Pittsburg man who tried to rob Lopez at gunpoint as he was sitting in his van and using his phone in the parking lot of the Rite Aid at 20 East 18^th St., police said.

Police said Lopez got out of the van, pulled a gun and fired several shots at his own vehicle as the suspect drove away. Police found the suspect suffering from gunshot wounds and he later died.

His name was not yet being released by Antioch police, who were not immediately available to provide further details on the case.

A friend of Lopez' said he is expected to be released from jail on Wednesday.
