49er Bruce Miller Avoids Domestic Abuse Charge, Faces Misdemeanor Case For Phone Smashing
SANTA CLARA (CBS SF) - 49er fullback Bruce Miller has been charged with vandalism for allegedly smashing his girlfriend's phone outside a Santa Clara hotel earlier this year.
Investigators initially said it the alleged victim and Miller were in a verbal argument near the Posh Bagel at Rivermark Plaza around 10:30 p.m. on March 5th.
"While original reports indicated that Miller may have pushed his girlfriend from his parked car, an investigation into the alleged assault was inconclusive," reads a statement from the Santa Clara County District Attorney's office.
Miller's girlfriend did not sustain any visible injuries and refused medical attention, according to the DA's office. She later denied that there had been any physical contact during the incident.
Miller, 27, was due to be arraigned Monday on misdemeanor vandalism charges at the Hall of Justice.
"Even relatively minor domestic violence incidents can be the first steps on a path that ends in tragedy. That's why we take all domestic violence cases seriously."said Supervising Deputy District Attorney Jim Demertzis in the release.
If convicted he faces up to a year in jail.
Miller is a four-year veteran who has started 42 games in the backfield for the 49ers.
