WATCH: Man Nearly Runs Over CHP Officer After Road Rage Incident

TRACY (CBS13) — A road rage confrontation with police was caught on camera after the suspect tried starting a fight with an innocent driver before nearly running over a California Highway Patrol officer.

Police say the suspect was under the influence of alcohol or drugs at the time. A video shows Faisal Mojaddid of Livermore challenging a bewildered driver to a fistfight in the parking lot of a Tracy In-N-Out Burger.

"Come out here. Come out here man, one-on-one, what's up."

Abrien Ybarra put down his burger and picked up his phone and started rolling.

"I gotta get this on film, I gotta watch this," he said.

Ybarra says Mojaddid got fighting mad, because he thought the other guy in the old muscle car was staring at him.

"But he was staring at his car, because all his windows were busted out," Ybarra said.

"You b---- n-----. You gonna try and (unintelligible)" *kicks car*

"He got more amped up when he noticed he was being recorded," Ybarra said.

The California Highway Patrol rolls up just as they're about to square off.

"F--- you! Get the f--- outta my face."

This is the point where you'd think things would settle down.

But when the cops show up, that's when things really escalated.

"Hey sir, I'm gone. I'm GONE!"

Mojaddid tells the CHP officer to get out of his face, and not in those words, before nearly running the officer over.

The video shows the officer jumping back to avoid being hit.

"This guy—I mean I'm surprised he didn't kill anybody on the road the way he was acting, the way he was driving, the state of mind he was in," Ybarra said.

This was no ride off into the sunset for Mojaddid. Police say they chased him onto Interstate 205 as he hit 100 miles an hour, before finally surrendering.

But that wasn't the end. The CHP says the suspect kicked the rear window out of a cruiser after being taken into custody.

Mojaddid is charged with DUI, vandalism, failure to yield, and assault of a police officer.
