MODESTO (CBS13) - Police say a Ceres off-duty officer shot and killed a man at a Modesto park on Sunday night.

The incident happened around 10:20 p.m. in Modesto's Beyer Park. Thomas Miller and a woman were walking in the park when a man identified as 29-year-old Jason Moland walked up and got into a confrontation with Miller. He allegedly pulled out a gun and pointed it at Miller who then pulled out his own gun and shot Moland, according to a Modesto Police Department statement.

When police arrived, Miller was reportedly administering CPR to Moland.

Moland was rushed to the hospital where he died of his injuries.

Miller will be placed on paid administrative leave during the investigation.
