Washington Co. Man To Be Resentenced In Child Porn Case

PITTSBURGH (AP) - A western Pennsylvania man is set to be resentenced in a child pornography case that saw his first conviction overturned because an appeals court found the trial judge prejudiced a jury by showing them too many video clips of child pornography the man allegedly possessed.

David Cunningham, 39, was retried and convicted again in August, prompting Wednesday's sentencing.

Cunningham, of Eighty-Four, was convicted and sentenced to 17½ years in prison in 2010. A federal appeals court overturned that decision after Cunningham's attorney argued there was no reason to show the clips from videos found on Cunningham's computer because he acknowledged they contained child pornography.

The trial judge showed the clips anyway, agreeing with prosecutors that jurors needed to see the violent nature of the pornography.
