Prosecution Rests In Case Against Man Accused Of Causing Fatal Crash
PITTSBURGH (KDKA) -- Prosecutors have finished making their case against a man accused of driving drunk the night he crashed last year on Saw Mill Run Boulevard.
The defense has begun its case in the trial of Robert Freund, charged with DUI in the death of James Posey last December.
The defense began with accident reconstruction expert Gregory Sullenberger and tried to convince the jury that had the victim been traveling slower than 44 miles an hour, he may have survived the crash.
The posted speed limit there is 40 and eventually was reduced to 35.
But the prosecution's final witness was a toxicology expert who testified that the defendant's blood alcohol level was 0.264 percent, which is 3.3 times the legal limit of 0.08 percent.
Jennifer Janssen, from the Medical Examiner's office estimated that Freund would have had to consume 9.7 drinks within less than an hour to reach that level of intoxication.
