Supreme Court Ruling Rebukes Obama's Immigration Plan

PHILADELPHIA (CBS) - On Talk Radio 1210 WPHT, Chris Stigall spoke to Carrie Severino, the Chief Counsel and Policy Director for the Judicial Crisis Network, and Jeffrey Rosen, the President and CEO of the National Constitution Center, about a Supreme Court decision upholding a lower court's ruling that prevented President Obama from implementing part of his immigration plan that would shield undocumented immigrants from deportation.

Severino said she agreed with President Obama that the ruling is a blow to a major part of his program.

"The President is right that it's a big blow because it means this action is certainly not going to be going forward in the near future and it may be completely dead in the water. We'll see what the next President wants to do in terms of trying to re-invigorate that kind of executive action. I think it will depend a little bit on who that President is."

Rosen agreed that it was a setback for the President but was puzzled by the Court's decision not to explicitly explain their ruling.

"It certainly was a big blow to a centerpiece of his immigration when the Court split and left the lower court decision in place. We don't know exactly what the justices' reasoning was because they issued just a one sentence opinion, nine words, the judgement is affirmed by an equally divided court, but everyone assumes it was the four conservative justices against the four liberal justices and the grounds for the challenge, there are several, one was that the President hadn't asked for a proper notice and comment and gone through the right procedures when he enacted this. Another is that he, basically, thwarted the will of Congress in that Congress has explicitly refused to enact the version of the program he was asking for. A third was that he violated the Constitution by failing to take care that the laws were faithfully executed."
