Pa. Supreme Court To Rule On SRC Effort To Void Teachers' Contract

By Mike DeNardo

PHILADELPHIA (CBS) -- The state Supreme Court is going to take up the issue of whether the School Reform Commission had the power to cancel its teachers contract.

The Pennsylvania Supreme Court says it will decide whether the School Reform Commission had the authority to void the teachers' contract and impose new terms, as the SRC did last October in a cost-saving move. The Philadelphia Federation of Teachers challenged the action in court, and won a ruling from Commonwealth Court in January. Now the Supreme Court will decide.

"We always said that this was an open question and it was something for the courts to decide," said Superintendent William Hite. "And we're glad it's finally getting to a place where we'll have a decision one way or the other."

No hearing date has been set.

There was no immediate comment from the PFT.
