Kane's Lawyers File Legal Briefs In Effort To Kill Grand Jury Presentment

PHILADELPHIA (CBS) - Lawyers for Pennsylvania Attorney General Kathleen Kane have filed a legal brief as she continues her effort to nullify a grand jury presentment that has recommended charges against her in connection with alleged grand jury leaks.
In the legal brief, Kane's lawyers argue that a judge had no authority under any current, valid state law to appoint a special prosecutor to conduct a grand jury investigation of the attorney general. They say there was once a statute that allowed for that, but that it expired in 2003.
The grand jury determined there was evidence to charge Kane with perjury and other offenses stemming from its probe of whether the attorney general leaked information covered by laws governing grand jury secrecy. Kane's lawyers argue the appointment of the special prosecutor should be quashed and that any presentment from the grand jury that investigated Kane should be vacated.
The state Supreme Court is to hear arguments on the matter next month.
