Former Federal Prosecutor Says He's 'Stunned' By Obama's Decision To Exchange Terrorists For American Soldier

PHILADELPHIA (CBS) – Chris Stigall spoke with Author and former Federal Prosecutor Andrew McCarthy about his book, Faithless Execution, and the swap of POW Bowe Bergdahl for detainees from Guantanamo Bay.

McCarthy says he is stunned with the decision by the White House to exchange terrorists for the American soldier.

"I think the fact that we would replenish the Taliban with its top commanders is one of the most astonishing derelictions of duty in the history of American warfare. This is a situation where the Taliban is still conducting against the United States and we have taken five of their most senior, most experienced, most implacably anti-American commanders and replenished their forces with them. That is just mind boggling."

He went as far as to suggest that the President's action in this case call for him to be impeached.

"High crimes and misdemeanors are not just statutory offenses; they are the public political wrongs of high public officials of whom great public trust has been endowed. They're more in the nature of the military code of justice, ideas like dereliction of duty and conduct unbecoming and the lot. When the Commander-in-Chief replenishes the enemy forces under circumstances where the enemy is still trying to kill American troops that the President not only has in the field, but has hamstrung with unconscionable conduct rules of engagement, that's a major dereliction of duty. That's the high crime and misdemeanor here."
