Both Sides in Pa. Same-Sex Marriage Fight Ask Judge To Fast-Track Decision

HARRISBURG, Pa. (CBS) -- Both sides in a federal lawsuit challenging Pennsylvania's ban on same-sex marriage are now asking the judge to skip a trial and make a ruling.

Challenging the law are eleven lesbian and gay couples, one widow, and two teenage children of one of the plaintiff couples.

In their petition for summary judgment, the plaintiffs' attorneys argue that all eight federal courts that have ruled on the issue since a US Supreme Court ruling last summer on the federal "Defense of Marriage" Act have deemed that banning same-sex marriage is unconstitutional.

Saying Pennsylvania's law "cannot stand under any level of scrutiny," they are asking the judge to declare it unconstitutional as well.

A spokesman for the Corbett administration says its attorneys are also seeking summary judgment in the case.
