NEW YORK (CBSNewYork) -- A man who police say accidentally fired a gun at the iconic Waldorf Astoria hotel Saturday night and his brother have been charged, police said.

CBS2's Matt Kozar reports that both men have been released from custody while the incident is under investigation, according to the Manhattan's District Attorney's Office.

Vladamir Gotlibovsky, 42, of Brooklyn, was charged with reckless endangerment, assault and tampering with physical evidence after firing his gun into the floor of the hotel's lobby, cops said.

His brother, Felix Gotlibovsky, 51, also of Brooklyn, was also arrested and charged with criminal possession of a weapon and tampering with physical evidence.

Police say Vladamir Gotlibovsky had a permit to carry the gun, CBS2 Matt Kozar reports, but then handed the gun off to his brother who hid it following the shooting, police said.

Police released a photo of the gun they recovered.

One woman was grazed in the head by a bullet, police said. Three other people were injured after being struck in their legs by flying marble, tile and glass.

The shooting happened around 7:30 p.m. during a wedding at the hotel on Park Ave and 50th Street.

Most of the guests were from Russia and would not discuss what happened with CBS2.

Guests at the hotel were stunned by the police activity.

"We were just walking in and I heard a gunshot. I thought something happened," one man said.

"We're absolutely astounded to arrive here and find out there's been a shot and etc, etc," Kevin Baskeyfield said.

The hotel said it was cooperating with the police investigation and that "the safety and security of our guests and team members are the hotel's top priorities."
