Sources: Midtown East Building Super Dead After Fight; Suspect Charged

NEW YORK (CBSNewYork) -- A suspect was charged late Tuesday after a Midtown East building superintendent died following a fight, sources told CBS2.

Police were called to 440 Park Ave., near 57th Street, at 12:12 p.m. Monday, the NYPD said. Officers found Roger Balan, 58, of Merrick unconscious and unresponsive at the scene, police said.

Balan was rushed to Bellevue Hospital Center, where he was pronounced dead, police said.

Sources said police believe Balan got into a fight with a bicycle messenger in the lobby of the building, and both threw punches. Balan collapsed in cardiac arrest, sources said.

Sources told 1010 WINS the messenger wanted to go straight to his desired floors without stopping on any other floors, and the two men got into blows over the issue and took it out into the street.

The messenger was apprehended at 40 Wall St. and was questioned late Tuesday, sources said.

Devon Givens, 35, of Brooklyn was charged with manslaughter late Tuesday night.
