Long Island Man Accused Of Drunken Driving With 4-Year-Old In Car

NEW YORK (CBSNewYork) -- A Long Island man is accused of driving while intoxicated after he crashed his car with his daughter inside the vehicle.

Suffolk County police said Jose Umanzor was driving a 2001 Honda Civic in a parking lot, located at 801 Crooked Hill Rd. in Brentwood, when he tried to make a U-turn and backed into an unoccupied, parked vehicle.

Police said Umanzor's 4-year-old daughter was in the car at the time of the accident. Neither suffered injuries.

The 34-year-old Brentwood resident was charged with aggravated driving while intoxicated under Leandra's Law, as well as endangering the welfare of a child.

The 4-year-old was released to a family member, police said.

Leandra's Law was adopted in 2009, creating a series of new crimes involving drunken driving while a child is in the car. It also established a requirement that all convicted drunken drivers install the breath-activated interlock devices in their vehicles. The law is named after Leandra Rosado, who at age 11 was killed when an SUV she and seven other children were riding in and being driven by an impaired woman crashed on the Henry Hudson Parkway in Manhattan.

Umanzor is scheduled to be arraigned at First District Court in Central Islip on Thursday.
