Guilty Verdict Upheld In Child Sex Abuse Case Against Ex-Yankee 'Rusty' Torres

NEW YORK (CBSNewYork) -- A Nassau County judge has upheld the guilty verdict against former New York Yankees outfielder Rosendo "Rusty" Torres in a child sex abuse case after his defense alleged there was juror misconduct during the trial.

The ex-ballplayer's defense claimed that jurors had been pressured to change their votes to end deliberations, the Nassau County district attorney's office said. The judge, however, said Torres' defense failed to prove his case and denied the motion to set aside the verdict.

Torres was found guilty in July of sexually abusing an 8-year-old girl while working as a youth baseball coach for the town of Oyster Bay. He was also found not guilty by the jury on charges of abusing a second girl under the age of 11.

The district attorney's office said the abuse occurred between April and May of 2012 during baseball practice in Plainview.

Police sources told CBS2 in May of 2012 the charges stemmed from two incidents over 10 days — that he exposed himself to the 8-year-old girl and inappropriately touched her.

Torres faces a maximum sentence of seven years in prison on each of the five counts of sexual abuse on which he was found guilty. He is due back in court for sentencing Dec. 11.
