Police: Armed Man Shot, Wounded By Officers In East Harlem

NEW YORK (CBSNewYork) -- Police shot and wounded a man they said was armed Tuesday night in East Harlem.

The incident happened shortly after 8 p.m. on First Avenue between 101st and 102nd streets, police said.

The man was carrying a gun, and officers shot him in the torso, police said.

Sources told CBS2 that officers were patrolling the area when they heard a gunshot, and saw two men quarreling.

As CBS2's Weijia Jiang reported, the two NYPD detectives had just made an arrest in a high-profile Stuyvessant Town, attempted rape case. The detectives stopped at a corner deli for a bite to eat when they found themselves caught up in a shooting.

They saw one suspect with a firearm and ordered him to drop the weapon, but he refused and allegedly turned and pointed it at officers – prompting them to open fire, sources said.

"The detectives immediately intervened in that shooting. One detective fired twice, striking the perpetrator while armed, running by him. He was then tackled to the ground by those detectives and the 22-caliber was recovered from the scene," said NYPD Chief of Detectives Robert Boyce.

Police said 26-year-old Wilvinson Diaz used the gun to shoot a 21-year-old man.

Both men were taken to local hospitals.

Diaz has been charged with attempted murder, felony assault, criminal possession of a loaded firearm, criminal use of a firearm, reckless endangerment and unlawful possession of marijuana in connection with the incident.
