David Tarloff Could Face Another Trial For Meat Cleaver Killing Of Therapist

NEW YORK (CBSNewYork/AP) - The schizophrenic man accused of fatally slashing a psychotherapist could face trial again.

It has been nearly six years since Kathryn Faughey was slashed to death with a meat cleaver in her Midtown office.

As WCBS 80's Irene Cornell reported, Faughey's brothers still find themselves coming to court hoping for a final resolution to the murder case against David Tarloff.

Tarloff doesn't dispute killing Faughey in Feb. 2008. His defense argues he was too mentally ill to be held criminally responsible.

The mental patient, who has been hospitalized 22 times, has been through two mistrials, Cornell reported.

In court Thursday, prosecutor Evan Krutoy pushed to get a third trial under way.

Tarloff was last found unfit to stand trial in November. Since then, he's been kept at Bellevue Hospital and his mental state has improved, Cornell reported.

Both sides said it's likely a trial can be scheduled.

Judge Edward McLaughlin ordered one more round of psychiatric examination before proceeding to trial.

Jury selection had been due to start Feb. 24 for prosecutors' third attempt to convict Tarloff. Now, that date will depend on the exam's findings.

On the day of the killing, Tarloff burst into Dr. Faughey's office intending to rob her colleague, psychiatrist Kent Shinbach. Tarloff said his intent was to get $40,000 to free his mother from a nursing home and take her to Hawaii.

Instead, he killed the first person he encountered, Cornell reported.
