Police: Bronx Dad Playing Catch With Son Is Struck, Killed On I-84

WAWAYANDA, N.Y. (CBSNewYork/AP) -- A New York City man whose car broke down on an upstate highway was struck and killed by a vehicle while playing catch with his son as they waited for a tow truck, authorities said.

Nicholas Barba, 35, of the Bronx was driving east on Interstate 84 Saturday night when his vehicle broke down in the Orange County town of Wawayanda, 55 miles northwest of New York City.

Troopers said Barba was tossing a baseball with his son on the highway's shoulder when an errant throw sent the ball across the interstate and into the median. Police said Barba retrieved the ball and was crossing back over when he was hit by a vehicle.

Barba was pronounced dead at a nearby hospital.

Troopers said the driver won't be charged.
