Prisoner on work crew assignment gets pot delivery, cops say

FORT PIERCE, Fla. - A Florida prisoner is accused of pocketing a baggie of marijuana tossed to him from a passing car while he was on a work crew assignment outside of prison, reports CBS affiliate WPEC.

Parell Seay, 22, of Tampa, was reportedly working alongside a road Tuesday morning when a small bag of pot was tossed to him from a passing car.

Seay was reportedly caught pocketing the marijuana and was arrested. During the arrest, Seay tried to reach into his picket to retrieve the baggie of drugs, according to an arrest affidavit obtained by the station. A deputy grabbed his arm and Seay resisted, sending the baggie into the deputy's face, the affidavit reportedly says.

After he was handcuffed and read his rights, Seay reportedly told the deputy that he doesn't do drugs but planned to bring it back to the Indiantown prison for someone else to use, according to the affidavit.

Seay told the deputy he didn't know who tossed the drugs to him and explained it's a "D.O.C. (Department of Corrections) thing" where former inmates toss contraband to current inmates on road crews, the affidavit says, according to the station.

The baggie reportedly contained one gram of marijuana. Seay was jailed on charges of resisting arrest, evidence tampering, marijuana possession and smuggling contraband into a prison.

Seay was already serving time for an August 2008 grand theft, as well as battery on a firefighter, police officer or EMT from January 2009 and burglary and possession of burglary tools from May 2009. He was sentenced in July 2009 to more than 6 years in prison and was scheduled to be released on Oct. 5, reports the station.
