Murder charge added for mother's boyfriend in birthday cake death of boy, 9

HAGERSTOWN, Md. - A grand jury has added murder to the charges facing a man accused of fatally beating a 9-year-old boy over a missing piece of birthday cake.

Washington County State's Attorney Charles Strong announced indictments Wednesday adding charges against all three people charged in the death of Jack Garcia of Hagerstown.

His mother's boyfriend, Robert Wilson, now faces charges of second-degree murder and child neglect. He was charged before Jack died with child abuse, assault, and reckless endangerment.

Jack's mother Oriana Garcia and her brother Jacob Barajas face new charges of assault and child neglect in addition to second-degree murder and first-degree child abuse.

The charges against each defendant carry maximum penalties of at least 150 years in prison.

Their defense attorneys did not return phone calls from The Associated Press.
