Man convicted in Ga. day care killing seeks new trial

DEKALB COUNTY, Ga. -- Hemy Neuman, the man convicted of killing Georgia businessman Rusty Sneiderman outside a suburban Atlanta day care center in 2010, is seeking a new trial, reports CBS Atlanta.

Neuman was allegedly having an affair with Sneiderman's wife, Andrea. Andrea Sneiderman has denied the affair and any involvement in her husband's murder. She was convicted last year of lying under oath and hindering the investigation into her husband's murder.

Neuman's attorneys have listed 23 reasons why he should be granted a new trial in a motion filed with the DeKalb County court, reports the station - among them, that Andrea Sneiderman was found guilty of lying during Neuman's trial.

Rusty Sneiderman was fatally shot November 18, 2010 outside a Dunwoody, Ga. day care center. Neuman, Andrea Sneiderman's former boss, was found guilty but mentally ill in the killing in March 2012. He is serving life in prison while receiving mental health treatment.

Neuman is expected to appear in court Tuesday afternoon to ask for a new trial, reports the station.

Andrea Sneiderman was found guilty in August 2013 on nine of 13 charges against her, including hindering the apprehension of a criminal, concealment of material facts, three counts of giving a false statement and four counts of perjury.

Prosecutors initially said Andrea arranged her husband's killing, but murder charges against her were dropped on the eve of jury selection in her trial.
