High school student accused of beating principal over headphones

NEW YORK -- Police say a high school student in New York assaulted his principal after the man asked him to turn down his headphones.

CBS New York reports the incident happened Monday at the Manhattan Early College School for Advertising inside Murry Bergtraum High School in lower Manhattan.

The principal, Matthew Tossman, reportedly asked 18-year-old Luis Penzo to turn down the volume of his headphones, but Penzo refused. According to the Department of Education, the principal was attempting to pick up the headphones from the ground when Penzo allegedly punched the man repeatedly in the face.

Metro reported Penzo was charged second-degree assault. He was expected to be arraigned Tuesday.

“The safety and security of students and staff is our top priority, and we are looking into it,” the Department of Education said in a statement released to the paper.
