Death of fetus found at NYC Victoria's Secret ruled homicide

NEW YORK - The death of a fetus found in a shopping bag at a New York City Victoria's Secret last fall has been ruled a homicide. On Tuesday, the New York City Medical Examiner's office said that the precise cause of death was asphyxia.

CBS New York reported last October that two teens were stopped by a security guard at the store on suspicion of shoplifting. One of the teens, 17-year-old Tiona Rodriguez, of Brooklyn, was found to be carrying a dead fetus in a shopping bag.

The teen told officers she was carrying the child's remains because she had delivered a day earlier and didn't know what to do, according to the station.

Rodriguez was hit with a shoplifting charge the day the fetus was found. As of late Tuesday, there was no word on whether the charges will be upgraded, authorities told CBS New York.
