Brian Fitch Appealing Conviction In Mendota Heights Officer's Death

MINNEAPOLIS (WCCO) -- The man convicted of killing a Mendota Heights police officer is appealing his conviction.

Brian Fitch, Sr. was convicted of killing Officer Scott Patrick during a traffic stop in July 2014. He was also convicted of shooting at the officers who arrested him several hours later in St. Paul.

Although those two incidents happened in different counties, the cases were consolidated into one. Fitch says he should have had two trials rather than one.

Fitch's public defender argues that the trial being consolidated was unconstitutional because it violates Fitch's right to a jury trial in the county where the charged crimes were committed.
