Appeals Court Affirms Tossed Counts In Waseca School Plot

MINNEAPOLIS (AP) — The Minnesota Court of Appeals has affirmed a lower court decision to dismiss the most serious counts against a teen accused of plotting to kill his family and carry out an attack at Waseca Junior and Senior High School.

In Monday's decision, the appeals court judges wrote that they can't speculate whether the teen would have carried out his plan.

The teen was arrested last April after authorities say they found him with bomb-making materials in a storage locker in Waseca, 70 miles south of Minneapolis. They also found a journal outlining plans to kill his family then attack the school.

Last July, a Waseca County judge dismissed four counts of attempted murder and two counts of attempted damage to property.

The teen still faces six counts of possessing explosives.
