DELTONA (CBSMiami/AP) — A grand jury has decided not to indict a central Florida deputy who fatally shot a man in the face during a drug raid earlier this year.

Volusia County prosecutors told local media Wednesday that Deputy Todd Raible will not face charges.

Authorities say deputies were serving a warrant at a Deltona home in March when 26-year-old Derek Cruice resisted. Raible fired one shot, hitting Cruice in the face. He was taken to a nearby hospital, where he later died.

Cruice was not armed, but Raible's attorney has previously stated that Cruice came charging at deputies with hands clasped in front of him during the raid.

Investigators reported finding during a search of the home nearly half a pound of marijuana, a scale, a drug ledger, pipes, plastic bags and about $3,000 in cash.
