MIAMI (CBSMiami) - A man accused of killing a man over dog poop now faces a first degree murder charge.

On Wednesday, a Grand Jury indicted 66-year old Omar Rodriguez.

According to the police report, last month Rodriguez got into an argument with Jose Rey who allowed his dog to defecate in the yard of Rodriguez's son's Kendall home.

After the two men exchanged words regarding the dog, the police report states that Rodriguez noticed what appeared to be a shiny object in Rey's hand. Rodriguez reportedly grabbed a gun and fired at least two shots striking Rey.

A witness told police Rey's wife ran to his side and Rodriguez threatened to shoot her too if she didn't leave him alone.

Rey, who underwent multiple surgeries, died.

Neighbors said Rodriguez, who lives about a mile away from his son, has harassed them for years and called the police to complain about them. According to Miami-Dade Police, records show Rodriguez has called police more than 90 times.
