Man Sentenced To 40 Years For Christmas Eve Mall Shooting

WEST PALM BEACH (CBSMiami/AP) — A man convicted in a deadly Christmas Eve shooting at the Boynton Beach Mall ten years ago has been sentenced to 40 years in prison.

Wilson Pierre Jr., who was convicted in May of second degree murder, was sentenced Monday.

Pierre was previously convicted of the same charge and sentenced to 40 years in prison, but an appellate court vacated that conviction in 2014 and ordered a new trial. The court ruled that Pierre's attorney was ineffective, especially regarding a contradiction in the jury instructions.

Berno Charlemond, 24, was killed in 2006 while the mall was crowded with thousands of holiday shoppers. Prosecutors said the mall shooting was related to a feud between two Haitian-American gangs.
