MIAMI (CBSMiami) – The man accused of sexually battering a 13-year-old girl appeared in court Wednesday.

"You are arrested for serious charges. I will appoint the public defender for you," the judge told 30-year-old Miguel Rodriguez.

According to court documents, this was a simple case of a person intent on no good.

Rodriguez is accused of luring a female juvenile into his car – something police always warn about.

The 13-year-old was walking from a bus stop before school on September 13th when she said a man pulled up and offered her a ride.

While driving in the car, police said Rodriguez fondled himself in front of his victim.

Authorities said Rodriguez drove the young girl to a remote location southwest of Homestead where sexually assaulted her.

Rodriguez is no stranger to the law. He has prior convictions for armed robbery and battery. Now he is in bigger trouble.

"Count one is $7,500. Count two is $100,000 plus house arrest," the judge said.

Count two is for forcing the 13-year-old victim to have sexual intercourse.

The public defender tried to get bail lowered, but that didn't happen.

"I am concerned about the safety of children in our community," the judge said.
