Gay Student Files Suit, Says Denied Tuition Break

FORT LAUDERDALE (CBSMiami/AP) – A Florida Atlantic University student, after being denied in-state tuition, is asking an appellate court to recognize his same-sex marriage.

Gildas Dousse filled the appeal Wednesday in state court.

The appeal alleges Florida's laws barring recognition of valid out-of-state marriages of same-sex couples are unconstitutional.

Dousset is a student at Florida Atlantic University. He and his spouse legally married in Massachusetts in 2013. Dousset applied for in-state tuition as the spouse of a long-time Florida resident, but says he was turned down because the school refused to recognize his marriage. The National Center for Lesbian Rights is handling Dousset's case.

Doussett said in a statement, "I would like my marriage to be recognized just as other students' marriages are."

FAU officials did not immediately comment.
