ORLANDO (CBSMiami/AP) — An Orange County deputy is being investigated by the Florida Department of Law Enforcement for shooting and injuring a suspected car thief.

The shooting happened early Monday after deputies responded to a call about a stolen vehicle that had been spotted. They followed the car to an apartment complex.

The sheriff's office reports that deputies approached the car and made multiple commands to the driver, who refused to comply. At some point the deputy says he felt threatened and fired at the driver.

The man was taken to an Orlando hospital in critical condition. He was reported to be in surgery Monday morning.

The passenger was arrested without incident.

The deputy who fired the shots has been with the department for nine years.
