Criminal Investigation Closed, No Charges Filed Against Colin Kaepernick

MIAMI (CBSMiami) – The State Attorney's Office has closed its criminal investigation into San Francisco 49ers quarterback Colin Kaepernick and two other NFL players.

Following a thorough investigation, including witness interviews, reviews of surveillance and more, the Miami-Dade State Attorney's Office closed the criminal investigation against Kaepernick, Seattle Seahawks wide receiver Ricardo Lockette, and 49ers wide receiver Quinton Patton.

The incident happened April 1st at the Viceroy Hotel at 385 Brickell Avenue.

A woman had told investigators from the City of Miami Police Department's Special Victims Office that she went to the hotel to visit Lockette who was staying there with Kaepernick and Patton.

The woman claimed she had passed out in a hotel room and awoke in a hospital not knowing how she got there.

According to the closeout memo, there is no evidence that indicated that the woman was victim of any crime.

Also noted in the memo, because of the woman's altered mental status the night of the incident, she was unable to provide any testimony to prove that she was sexually assaulted or the victim of any other offense.

Her body, according to a medical examination, did not reveal any evidence of physical trauma and rape kit swabs revealed no seminal fluid—only toxicology tests revealed the presence of drugs she had admitted to consuming.

The investigation, as a consequence of the information acquired, has been "exceptionally cleared," by the Office of the State Attorney's Office, according to the memo.
