Court To Hear Arguments In Teacher Evaluation Case

MIAMI (CBSMiami/ NSF) -- A federal appeals court is expected to hear arguments in the battle on the constitutionality of a system which tied teacher evaluations to student performance in Florida.

The hearing is scheduled for April 22nd, according to an online docket.

U.S. District Judge Mark Walker last year upheld the system in a challenge spearheaded by the Florida Education Association teachers union. The case then went to the 11th U.S.
Circuit Court of Appeals, which will hold a hearing next month in Montgomery, Ala.

The system stems from a 2011 law, known as the "Student Success Act," which was highly controversial.

Critics took issue, in part, with part of the law that allowed some teachers to be evaluated based on the test scores of students who were not in their classrooms.

Similarly, teachers could be evaluated on student test scores in subject areas they didn't teach.
