Bond Set For Third Person Charged In Deadly Drive-By

MIAMI (CBSMiami) - A judge has set bond at $50,000 for a third person charged in a deadly drive by shooting in Richmond Heights over the weekend in which a seven year old boy died.

Michael Tobler, 19, was arrested late Wednesday and charged with attempted second degree murder and aggravated assault with a firearm.

On Sunday, Maxwell Trewin, 18, Dravein Duke, 19, and three other teens drove to Tobler's house at 15120 Jackson Street to buy marijuana, according to Tobler's arrest report.

After Duke reportedly bought some pot, he got into an argument with Tobler over a possible stolen gun. As the fight grew more heated, police say Tobler pulled a gun from his pocket, shoved it in Duke's abdomen and said "don't f*** with me, I'll kill you!"

Duke went back to the vehicle and as Trewin drove off, Tobler allegedly fire three shots at it. Duke and Trewin reportedly armed themselves with the high powered rifle and then went back.

Duke, also known as "Pop," is accused of unleashing the barrage of bullets into Tobler's home.  Amiere Castro, 7, who was inside watching television, was struck in the head and pronounced dead on scene. Neighbors said Castro was visiting relatives for the holidays.

Late Monday, police announced they had found the truck they believe was used in the drive-by less than a mile away from the shooting scene and arrested Trewin who they say was behind the wheel.

Duke turned himself in to police on Tuesday. Both Duke and Trewin faces several charges including second degree murder and attempted murder.

Both Duke and Trewin have police records. In addition to a previous arrest for grand theft Duke, a former Killian High School student, has also been arrested for carrying a concealed weapon. Trewin was on probation for burglary and grand theft.
