California Supreme Court Rules Ex-Anna Nicole Smith Attorney May Face New Trial
LOS ANGELES (CBSLA.com) — A former attorney for Anna Nicole Smith may be retried on charges of conspiring to provide prescription drugs to the late reality television star.
KNX 1070's Jon Baird reports the California Supreme Court ruling Monday could put Howard K. Stern back before a judge if a trial court grants his motion for new trial.
Stern's 2010 conviction on two counts of conspiracy had been overturned by a trial judge, but that decision was later reversed by an appeals court. The case now moves to back to the trial court.
Smith died of an accidental drug overdose in February 2007.
Attorney Steve Sadow said his client simply wants to reach some kind of resolution that would allow Stern to continue to practice law.
"We want to do what's best for Howard," said Sadow. "It's been a long time."
If a judge rejects the new trial motion, Stern would then be sentenced on his original conviction on the conspiracy counts.
