Texas Court Case Could Re-Open Issue Of Using Race As Factor For College Admissions

DETROIT (WWJ/AP) - An Appellate courts says the University of Texas at Austin can continue using race in its admissions process. The decision comes after the United States Supreme Court ordered the lower court to take another look at its original decision to uphold Affirmative Action at the university.

Larry Dubin, a University of Detroit law professor, says if the Supreme Court takes up the case again it could have wide-ranging effects.

"If the Fisher vs Texas case goes back to the United States Supreme Court - then their decision will have an impact on all public universities throughout the country," said Dubin.

If the plaintiff in the Texas case decides to challenge the Appellate Court's decision ... the higher court could take up the issue in September when that court comes back from summer recess.
