Sister Of Theater Shooting Suspect Watching Proceedings

CENTENNIAL, Colo. (AP) — The sister of the Colorado theater shooting suspect is in court.

Chris Holmes was first in court Monday, sitting between her parents in the public gallery just behind her brother. As Tuesday's hearing began, the defense team apologized to the judge and said they had mistakenly informed her she could be in court even though she may later be called as a witness. Chris Holmes left and after consulting with prosecutors, who said they had no objection to her presence, Judge Carlos A. Samour Jr. said she could return.

Monday, jurors heard from the second of two state-appointed psychiatrists who have determined Holmes was mentally ill but legally sane at the time of the attack that killed 12 and injured 70.

Holmes has pleaded not guilty by reason of insanity.
