Sexual Assault Charges Dismissed Against Canadian

DENVER (CBS4)- The Denver District Attorney's Office dismissed sexual assault charges against a man from Canada on Monday.

Colby James Messer was charged in April with six counts of sexual assault in connection with what was called a brutal sexual assault of a 27-year-old woman at a Denver hotel in November 2015.

According to Lynn Kimbrough with the Denver DA's office, new information led to the determination that those charges could no longer be proven beyond a reasonable doubt.

The DA's office released this statement, "Prosecutors have an ethical duty to dismiss charges if they determine there is no longer sufficient evidence to prove a case beyond a reasonable doubt."
