Holmes' Change Of Location Bid Fails

DENVER (CBS4) – Aurora theater shooting defendant James Holmes has failed in his bid to change the location of his trial for now.

Arapahoe District Court Judge Carlos Samour deferred the change of venue motion on Friday.

In a written opinion he wrote he has "unwavering confidence" that a fair jury can be chosen in the county where the 12 people were killed and dozens were injured.

Holmes' public defenders had maintained that overwhelming and prejudicial publicity made it impossible for a fair verdict to be reached.

The judge did not outright deny the motion, but will wait until they start selecting a jury to see.

The trial is now set for October.

Holmes has pleaded not guilty by reason of insanity and is to undergo a second psychiatric exam at the state hospital in Pueblo.
