Federal Appeals Court Bars Chicago From Banning Magazine Vendor

CHICAGO (AP) — A federal appeals panel has barred the city of Chicago from enforcing an ordinance that prohibits a man from selling his baseball magazine on sidewalks outside Wrigley Field.

The emergency injunction by the 7th U.S. Circuit Court of Appeals means Matt Smerge can sell his "Chicago Baseball" magazine immediately outside the stadium when the Chicago Cubs host the New York Mets in Game 3 of the National League Championship Series Tuesday night.

Smerge sued the city after a police officer ticketed him during the April home opener for violating an ordinance that bars peddling on the sidewalks adjacent to the Cubs' home. He was ordered to move across the street.

The appeals court ruled Monday after the city said it would not enforce the ordinance while Smerge's appeal is pending.
