Victory For Man Who Spent 35 Years In Prison For Murder He Says He Didn't Commit

BOSTON (CBS) -- Massachusetts' Supreme Judicial Court rejected a prosecutor's request to reinstate Fred Weichel's murder conviction.

In April, a judge threw-out Weichel's conviction for the 1980 murder saying investigators didn't give the defense a police report.

That report suggested that there could have been another suspect in the crime.

Weichel is presently free on bail.

There is no word if another court date for Weichel has been set.
