Prosecutors say Flavio Daveiga was charged Wednesday with murder in the previously unsolved case related to 24-year-old Edwin Rivera Jr.

Investigators say police received a call just before midnight Nov. 25, 2013, about a man struck by a train. Rivera was pronounced dead at the scene. An autopsy determined Rivera died from gunshot wounds.

Daveiga was arrested two days later and charged with accessory to murder before the fact and obstruction of justice related to witness intimidation. Those charges were upgraded Wednesday.

Daveiga has been held since his arraignment in 2013. He's due back in court Dec. 3.

It's unclear if he has an attorney.
