Prosecutors Say New DNA Testing Ties Dedham Man To Two 2004 Rapes
BOSTON (CBS) – A Dedham man was back in court Monday to face charges of armed robbery and rape after being freed earlier this year because DNA testing could not distinguish him from his twin brother.
Dwayne McNair, 33, pleaded not guilty in Suffolk Superior Court to charges of aggravated rape and armed robbery related to sexual assaults on two women during separate attacks in September 2004.
Dwayne McNair was originally arrested and charged in 2012. His twin brother was also implicated.
Prosecutors say new "state-of-the-art" DNA testing done in Germany shows Dwayne McNair is the suspect in the rapes and not his twin brother.
Defense attorney Robert Tobin questioned the new DNA test, saying it is "not generally accepted"
Prosecutor David Deakin said the "second generation" DNA test cost $100,000.
McNair was ordered held on $500,000 cash bail.
