Daily Talker: Mandatory Flu Vaccines For Day Care, Pre-School

BOSTON (CBS) - A group of mothers is suing New York City over mandatory flu vaccines.

Children between 6 months and 5 years old must get the flu vaccine to attend public day cares and pre-schools in the city.

The lawsuit filed in Manhattan Supreme court this week argues that the policy is illegal because it was passed by the city's health department but not voted on by state lawmakers.

A similar argument was used to help defeat a ban on soda in the city.

The lawsuit also claims that state lawmakers have repeatedly declined to add the flu shot to a list of 11 mandatory vaccines.
